4 Ways to Diffuse Negative Responses

Email and SMS Marketing for criminal defense isn’t perfect. In rare cases, our system will find and email/ phone number for an individual who has the same name, age, and lives in the same county as a person who was arrested, but was not actually arrested themselves.

Most of these individuals will opt-out via the initial email we send them before sharing their data with you, but a few fall through the cracks.

Wrong recipients may be be upset they were contacted or worried their information was stolen. Here are three things to do when communicating with wrong recipients to diffuse negative responses for your criminal defense marketing campaign.


1. Tweak your message.

Not surprisingly, the easiest way to prevent negative responses is with your message itself. Here are a few sentences you can integrate into your message to alleviate wrong-recipient’s concerns.

  • If you have not been arrested, please disregard this message.
  • Ignore this message if you have not been arrested.
  • To opt-out of future texts, reply STOP.
  • Please click the unsubscribe link below if you have not been arrested.

Giving wrong-recipients something tangible to do when they’re contacted by mistake can go a long way in diffusing a negative response. Get ahead of things and make sure you have this integrated.


2. Be cordial.

You’re busy. We get it.

That being said, taking the time to explain how their information was obtained will only cost you a few extra minutes and could save you a big headache.

Here’s how you can explain what happened to wrong recipients:

  • Your information has not been stolen.
  • You have the same name and age as someone who was recently arrested.
  • Our system found your email/phone by mistake instead of the arrestee and sent you an email/ text.
  • We apologize for the inconvenience this has caused you.

You never know– a wrong recipient could one day turn into a prospective criminal client. Taking the time to thoroughly explain the situation to a wrong recipient could turn into a family-member referral or new case.


3. Invite them to opt-out.

There’s an easy way to ensure they don’t receive any further emails or texts from your criminal defense marketing campaign.

Recipients can opt-out from further criminal law marketing by:

  • Replying STOP to any text message they received from you.
  • Clicking the Unsubscribe button at the bottom of each email they received from a law office.

Here’s a sample response you can use to communicate with wrong recipients leads to respond via email:

Dear _____,

Thank you for your message. We apologize for the inconvenience our messages have caused you.

Please note that our information was not stolen– your contact information was mistakingly associated with someone who was recently arrested by a combination of address, name, and/or age. In other words, our system found your email/phone by mistake instead of the arrestee and sent you a message.

We sincerely apologize for our mistake. To opt-out of further communication, just click on the “Unsubscribe” link at the bottom of the marketing email you received from us. We’ll take care of the rest.

4. Have them contact us.
